0. What Gfit Cards Is & Key Definitions

Gfit Cards is a retailer of fitness challenge gifts. A buyer (the "Sponsor") purchases a challenge gift for a recipient. When the recipient completes the challenge through verified physical activity, we deliver the "Reward": a digital gift card of the recipient's choosing from our catalog of third-party brands, which we purchase at our own expense at the time of fulfillment.

The Sponsor's payment is the purchase price of this product and becomes our revenue at the time of sale, together with our binding obligation to deliver the Reward on completion or refund the Reward value as described in Section 4. We do not hold funds on behalf of Sponsors or recipients, we do not issue prepaid cards, and no part of the Service provides money transmission, cash, or cash-equivalent value. Rewards are always single-brand gift cards redeemable only with the issuing brand.

1. The Product

• A challenge gift has a stated Reward value (e.g., $25, $50, $100, up to a maximum of $200) and a challenge the recipient completes by logging verified physical activity in the App.
• All fees are charged to the Sponsor at purchase, on top of the Reward value. Nothing is ever deducted from the Reward the recipient earns.
• Purchases are subject to a limit of $500 in challenge gifts per buyer per day.

2. Eligibility & Age Requirements

• You must be at least 18 years old to create an account and redeem a Reward.
• Anyone may purchase a challenge gift. Minors may participate in the fitness challenge portion under parental supervision, but all Reward redemptions must be completed by an account holder who is 18 or older.

3. The Reward Guarantee

• Completion creates a contractual right to the Reward. When the recipient completes the challenge in accordance with these Terms, we are obligated to deliver a gift card of the recipient's choosing from our then-current catalog, in the full Reward value.
• Earned Rewards do not expire. A completed challenge's Reward remains redeemable indefinitely, and in no event less than five (5) years from completion, with no fees of any kind.
• Delivered gift cards are issued by the selected brand and are subject to that brand's own terms.
• We may delay or withhold fulfillment where we have a good-faith basis to suspect fraud, falsified workout data, or a violation of Section 6 — in which case we will notify the account holder and, if the concern is not resolved, refund the Sponsor per Section 4.

4. Challenge Window, Lapse & Refunds

• Every challenge has a 12-month window from the date of purchase.
• If the challenge is not completed within the window, we refund the Sponsor the full Reward value to the original payment method — regardless of partial progress. The service and processing fees, which pay for the Service itself, are retained.
• Paid-forward gifts lapse differently. The forwarded value of a challenge gift created by spending an earned Reward (Section 5, "Pay It Forward") was not paid in cash, so its lapse is not refunded in cash. Instead, that value returns to the sender as an earned Reward — which does not expire and can be redeemed or paid forward again. Any cash the sender added to the gift at forward time is refunded to their original payment method, and the service fee paid on the hop is retained, exactly as with a purchase.
• Every dollar of Reward value therefore always ends in a defined state: delivered as an earned Reward, refunded to the Sponsor, returned to a sender as an earned Reward, or held as an earned-but-unredeemed Reward that does not expire.

5. Reward Fulfillment

• Upon completion, the recipient selects a brand in the App and the gift card is delivered digitally, normally within minutes.
• The recipient may split the Reward across up to five brands, in any combination of values that together equal the full Reward value.
• Pay It Forward. Instead of a gift card, the recipient may spend their earned Reward on our other product: a new challenge gift for someone else. The new gift carries the full Reward value — a service fee, shown before checkout, is paid separately at forward time and is never deducted from the Reward. The sender may also add to the gift at forward time; the addition raises the new gift's value dollar-for-dollar. The new recipient earns the gift through the same challenge flow. An earned Reward is store credit spendable only on these two products — it is not transferable as money and cannot be sent to another person except as a challenge gift they must earn.
• The catalog contains single-brand (closed-loop) gift cards only. We do not offer cash, bank transfers, or general-purpose prepaid cards, and Rewards cannot be converted to cash except where required by law.
• Catalog brands vary over time; at least one nationally recognized brand will always be available at every Reward value we sell.

6. User Accounts & Conduct

You are responsible for maintaining the confidentiality of your account. You agree not to:

• Create multiple accounts for abusive purposes
• Attempt to manipulate challenge tracking or engage in fraud
• Submit false workout data or use automation to simulate physical activity
• Upload false, misleading, or harmful content
• Use the Service for any illegal purpose

7. Fitness & Health Disclaimer

Our Service involves physical activity tracking. You acknowledge that:

• Jogging and physical exercise carry inherent risks of injury.
• You participate at your own risk and are solely responsible for your health and safety.
• We are not a medical service and do not provide medical advice.
• Consult with a qualified healthcare professional before beginning any new fitness program.

8. Intellectual Property

All content, logos, designs, and technology on the Service are owned by Gfit Card LLC. You may not copy, modify, or distribute our content without permission.

9. Limitation of Liability

To the fullest extent permitted by law, Gfit Card LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

Our total liability to you shall not exceed the amount you paid to us in the twelve months preceding the claim or, for recipients, the Reward value of the affected challenge gift.

10. Termination

We may suspend or terminate your account for violation of these Terms. Termination does not extinguish an earned Reward or a Sponsor's refund rights under Section 4, except where the Reward was earned through fraud or falsified data.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page. Changes do not reduce the Reward Guarantee or refund rights attached to challenge gifts already purchased.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in Arapahoe County, Colorado, in accordance with the rules of the American Arbitration Association.

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
